A lasting power of attorney is one of the most important documents you can put in place while you are still well, so that someone you trust can act for you if you ever cannot act for yourself.
What a lasting power of attorney does
A lasting power of attorney, or LPA, lets someone you trust, such as a family member or close friend, make decisions on your behalf if you ever become unable to do so through illness, accident or old age. There are two types, and you can put one or both in place.
Health and welfare
This lets the attorney you choose make decisions about your medical care, where you live, and the treatment you receive, if you cannot express those wishes yourself.
Property and financial affairs
This lets your attorney manage your finances, pay your bills and make financial decisions. Without it, banks and other institutions may freeze accounts or require a long court process before anyone can step in.
The Islamic view
Taking reasonable steps to safeguard your dependents and your property is an act of foresight and responsibility. Naming a trustworthy attorney ahead of time spares your family avoidable hardship.
Without an LPA
If you lose capacity with no LPA in place, your family may face legal delays, the court may appoint someone to make decisions who you would not have chosen, and the cost and stress arrive at the worst possible time.
